This Standard sets forth the safety specifications that shall be met for electrical appliances and products, in order to prevent and eliminate the risk of bodily harm caused to users, as well as to preserve their property.

Safety specifications referred to in the Norma Oficial Mexican (Official Mexican Standard) NOM-003-SCFI-2014 apply to electrical products using as power supply the public electricity supply, as well as other energy sources, such as batteries, accumulators and self-generation, alternating current (AC) and/or direct current (DC), with a rated voltage up to 1 000 V AC and up to 1 500 V DC.

The Standard structure meets the needs for compliance with safety specifications for electrical products sold within the territory of the United Mexican States. To this effect, seven sections, which refer to a series of Mexican standards on safety requirements, have been defined.

I. Certification Services

UL Mexico has the accreditation and approval to carry out product certification within the scope of the Norma Oficial Mexicana NOM-003-SCFI-2014, which refers to Mexican standards contained in the following sections:

II. Process of certification of product

The process of certification of product according to the NOM-003-SCFI-2014, is carried out according to the following flow:

 

III. Product certification schemes

UL Mexico is accredited and approved to carry out the Product Certification Process in accordance with the NOM-003-SCFI-2014 and according to the following certification schemes:

A) Certification Scheme with Product Follow-Up at the Point of Sale or during Marketing, (9.6.1 of NOM-003-SCFI-2014).;

‘The scheme is based on the type-examination procedure. An accredited and approved body shall assess conformity and issue, if applicable, a Certificate of Compliance.’

  • This scheme is based on type testing;
  • The validity of certificates issued under this scheme is one year. Certificates may be also renewed for the same period, based on the follow-up performed to initial certification;
  • Under this product certification scheme, at least two follow-ups are performed during the validity of the NOM certificate;
  • Where the certificate covers a product family, the follow-up is made on a representative family model, preferably different from the model assessed in the initial or previous certification;
  • The type sample is taken at random during marketing or at the point of sale. If there is no product at the point of sale, you may take a type sample from the certificate holder’s warehouses;
  • The tests conducted during the follow-up are performed in accordance with the NOM-003-SCFI-2014 for each NMX Standard.

B) Certification Scheme with Factory or Warehouse Product Follow-Up. (9.6.4 of NOM-003-SCFI-2014);

“The scheme covers the production phase and is based on the type-examination procedure. An accredited and approved body controls conformity with the type and issues a Certificate of Compliance”

  • This scheme is based on type testing;
  • The validity of certificates issued under this scheme is one year. Certificates may be also renewed for the same period, based on the follow-up performed to initial certification;
  • The initial term of the certificate issued under this scheme may be extended to two years if the following is met:
  • The certificate holder is established in accordance with the Mexican law
  • The certificate holder proves a history of at least 5 (five) years in compliance processes with no cancellations because of non-compliance with the NOM
  • Under this product certification scheme, at least one follow-up is performed during the validity of the NOM certificate;
  • Where the certificate covers a product family, the follow-up is made on a representative family model, preferably different from the model assessed in the initial or previous certification;
  • The type sample is taken in the factory or warehouse. It is selected randomly from the production or a representative batch.
  • The tests conducted during the follow-up are in accordance with the NOM-003-SCFI-2014 for each NMX Standard.

VI. General Considerations to carry out the Product Certification Process

The Product Certification Process requires that the NOM certificate holder be properly registered in UL de Mexico, a process performed the first time the owner requests the product certification service. For this purpose, the party interested in product certification should submit:

  1. Two signed hard copies of the Service Contract;
  2. A photocopy of the Articles of Incorporation of the company interested in product certification;
  3. An official identification of the legal representative of the company interested in product certification;
  4. A photocopy of the company’s legal representative’s power of attorney with the relevant powers to enter into and sign contracts;
  5. A photocopy of proof of address

V. Requirements to carry out the Product Certification Process

a) Requirements to deliver the application form for monitoring product certification scheme point of sale or marketing (Scheme I) are as follows:

  1. Documents listed in Section A hereof, except for Point 8 in Section A, which refers to production homogeneity
  2. Test Report issued by an accredited laboratory and approved according to the number of type samples specified in the applicable standard (type testing). Letter of Commitment that describes and assumes the responsibility that the submitted type sample is representative of the product to be certified. The interested party will be responsible for reporting any change in the product, once it has been certified. The interested party may choose to submit duplicate type samples for use as a blank sample to be used in case of doubt or for type retests. The agency will be awaiting the relevant test report, if necessary.
  3. Request for Certification and document stating under oath the product category, whether it be new or not new (rebuilt, used or second-hand, second-line, end-of-sale, or reconditioned equipment)

These documents are submitted to the Certification Body (CB) to perform the certification process according to the Scheme I described herein.

b) The requirements to deliver the application form of certification for the scheme of certification with follow-up of the product in factory or winery (Scheme IV) are the following:

  1. Documents listed in Section A hereof;
  2. Test Report issued by an accredited and approved laboratory, according to the number of type samples specified in the applicable standard (type testing). Letter of Commitment that describes and assumes the responsibility that the submitted type sample is representative of the product to be certified. The interested party will be responsible for reporting any change in the product, once it has been certified. The interested party may choose to submit duplicate type samples for use as a blank sample to be used in case of doubt or for type retests. The agency will be awaiting the relevant test report.
  3. Request for Certification and document stating under oath the product category, whether it be new or not new (rebuilt, used or second-hand, second-line, end-of-sale, or reconditioned equipment).

These documents are submitted to the Certification Body to perform the certification process according to the Scheme IV described herein.

VI. Terms and deadlines

The response time to the request for certification services is a maximum period of three business days for new products and twenty business days for non-new products, once the information requested as certification requirements is available.

The Certification Body shall inform the requester, through communications, the deviations identified during the certification process. The response time for the Certification Body to analyze the actions arisen from communications, in order to give attention to the deviations registered by the requester, shall be three business days.

Response times shall be from the business day following the date of registration of the request or requested information.

If the Product Certification Body issues communication reporting deviations in the documents registered, the requester shall have a period of 90 calendar days, from the day after the requester has been notified. If stated failures are not corrected within the prescribed period, the Certification Body will generate a record stating the reason why they did not give the certification, ending so the process.

If the product does not comply with the applicable standard, the Product Certification Body will generate a document stating the reason for the failure.

Section A (General considerations and technical documentation)

The certificate owner shall create an electronic or printed record with product technical documents.

Technical documents depend on the equipment nature. It should include the documents required, from a technical standpoint, to identify and prove thoroughly product conformity with applicable specific standards.

The record shall be available to the competent authorities for inspection and control purposes, and to certification bodies for conformity assessment purposes.

Any certification holder or person responsible for the marketing of a product in the Mexican market shall have access to the record with the manufacturing technical documents or assurance that they will be able to submit the record as early as possible in case of a justified request.

The record shall be kept for a period of five years after the last date of manufacture, import or sale of the product.

Contents of the Product Technical Document record

As specified above, the record shall at least contain the following elements:

  1. General product description;
  2. Standards fully or partially applied. In cases where standards have not been applied, you should include a description of the solutions found to meet the NOM safety aspects;
  3. Technical reports with conducted test results obtained from an accredited and approved laboratory.
  4. Electrical diagrams;
  5. Technical documents required to analyze and trace the software that performs a safety control function, if required by the product standard;
  6. Photos of the product;
  7. Essential Component List, where any of the standards listed in Chapter 7 describes the specific component requirements. The Essential Component List should correspond to those components specified in the Mexican product standard;
  8. Production homogeneity. All the required measures taken by the manufacturer, so that the manufacturing process ensures conformity of manufactured products (it applies to procedures where production phase is included). This requirement only applies only for the scheme 9.6.4 of NOM-003-SCFI-2014.

NOTE:  In case of verification by the authority, the Product Certification Body, jointly with electrical product suppliers, shall provide the analysis, version identifiers, control measure identification, and schematic diagram of the software that performs the safety control function to determine compliance with the reference standard.
